Misconceptions

The ICE I-983 form, also known as the Training Plan for STEM OPT Students, is often misunderstood. Here are seven common misconceptions about this form:

  1. Only students on STEM OPT need to fill out the I-983.

While primarily associated with STEM OPT, the I-983 is also relevant for employers who wish to support students in their training plans, regardless of the student's specific visa status.

  2. The I-983 is only a formality.

This form serves a significant purpose. It outlines the training plan and ensures that students receive relevant practical experience that aligns with their field of study.

  3. Once submitted, the I-983 cannot be changed.

In fact, students can update the I-983 if there are changes in their training plan or employment. Keeping the form current is crucial for compliance.

  4. Employers do not need to be involved in the I-983 process.

Employer involvement is essential. The form requires input from both the student and the employer to accurately reflect the training experience.

  5. The I-983 is only for academic institutions.

While it is often associated with schools, the I-983 can be utilized in various settings, including private companies and research institutions.

  6. Completing the I-983 guarantees approval for STEM OPT.

While a well-prepared I-983 is important, approval for STEM OPT depends on meeting all eligibility criteria set by USCIS.

  7. The I-983 form is a one-time requirement.

Students must submit a new I-983 for each new employer or if there are significant changes to their training plan, ensuring ongoing compliance with regulations.

Understanding these misconceptions can help students and employers navigate the I-983 process more effectively.

Similar forms

The ICE I-983 form, known as the Training Plan for STEM OPT Students, shares similarities with the Form I-20, which is a Certificate of Eligibility for Nonimmigrant Student Status. Both documents serve as essential tools for international students in the United States. The Form I-20 outlines the student’s program of study, including details about the institution and the duration of the program. Like the I-983, the Form I-20 requires approval from a designated school official (DSO) and is crucial for maintaining lawful student status. Both documents ensure that the student is complying with immigration regulations while pursuing their educational and professional objectives.

Another document that resembles the I-983 is the Form I-765, Application for Employment Authorization. This form is critical for students seeking to work in the U.S. under specific circumstances, such as Optional Practical Training (OPT). Similar to the I-983, the I-765 requires detailed information about the applicant's eligibility and the nature of the employment. Both forms are part of the process that allows students to transition from academic life to practical work experience, emphasizing the importance of aligning educational goals with professional development.

The Form I-9, Employment Eligibility Verification, also parallels the I-983 in that it is used by employers to verify the identity and employment authorization of individuals hired for work in the U.S. While the I-983 focuses on the training plan and the educational context, the I-9 ensures that the individual has the legal right to work. Both documents play a vital role in the broader framework of immigration compliance, ensuring that students and workers adhere to the regulations governing their respective statuses.

Lastly, the Form DS-2019, Certificate of Eligibility for Exchange Visitor Status, is another document similar to the I-983. This form is used for individuals participating in exchange visitor programs, allowing them to engage in work and study in the U.S. Like the I-983, the DS-2019 outlines the purpose of the program and the responsibilities of the participant. Both documents require endorsement from an authorized official and are integral to maintaining lawful status while participating in educational and professional activities in the United States.

Documents used along the form

The ICE I-983 form, known as the "Training Plan for STEM OPT Students," is essential for international students seeking to extend their Optional Practical Training (OPT) in the STEM fields. However, several other forms and documents may accompany the I-983 to ensure a smooth application process. Below is a list of commonly used forms and documents that complement the I-983.

  • Form I-765: This form, titled "Application for Employment Authorization," is necessary for students applying for work authorization under the OPT program. It allows individuals to legally work in the United States while their application is being processed.
  • Form I-20: Issued by the student's Designated School Official (DSO), this document certifies the student's eligibility for F-1 status and outlines their program of study. It is crucial for maintaining lawful student status during the OPT period.
  • Form I-94: This form serves as a record of the student's arrival and departure in the United States. It is essential for verifying the student's legal entry and status, which is important when applying for OPT.
  • Employer Letter: A letter from the employer detailing the job offer, including the role, responsibilities, and how the position relates to the student's field of study. This document strengthens the application by providing context for the training plan.
  • Resume: A current resume outlining the student's education, work experience, and skills. This document helps to present the student’s qualifications and relevance to the proposed training position.

These forms and documents collectively support the I-983 application process, ensuring that students can effectively navigate the complexities of extending their OPT. Each piece plays a vital role in demonstrating eligibility and compliance with immigration regulations.
