Misconceptions

1. Misunderstanding the Trainer's Liability: Many owners believe that the Trainer is fully responsible for any injuries or illnesses that occur while the horse is in their care. In reality, the Trainer is only liable for negligence. The Owner assumes most risks associated with equine activities.

2. Assumption of Risk is Optional: Some owners think they can opt out of the assumption of risk clause. However, this is a standard part of the contract, and by signing, they acknowledge and accept the inherent risks of horse training.

3. Guarantee of Training Results: A common misconception is that the Trainer guarantees specific outcomes from the training program. The Trainer clarifies that results depend on the horse's individual abilities and cannot be promised.

4. Emergency Care Authorization: Owners often believe they must be contacted before any emergency care is administered. The contract allows the Trainer to act in the horse's best interest if the Owner cannot be reached.

5. Understanding of Fees: Some owners assume that all fees are fixed. The contract specifies that fees can vary, and additional costs may arise, especially if services like veterinary care are needed.

6. Ownership of the Horse: Owners may mistakenly think they can board any horse without proof of ownership. The contract requires proof of ownership and a negative Coggins test for all horses.

7. Right to Lien Misconceptions: Some owners believe the Trainer cannot hold their horse for unpaid fees. However, the Trainer has a legal right to a lien under New Mexico law, which allows them to retain the horse until debts are settled.

8. Changes to the Agreement: Owners often think they can make changes to the contract without notice. The Trainer can modify or terminate the agreement with thirty days' written notice, which is a crucial detail for owners to understand.

9. Insurance Coverage Misunderstandings: Many owners are unaware that the Trainer does not carry insurance for horses not owned by them. Owners are encouraged to obtain their own insurance for any horse valued over $5,000.

that may contribute to injury to the participant or others, such as failing to maintain control over the animal or not acting within such participant’s ability.

Owner expressly releases Stable from any and all claims for personal injury or property damage, even if caused by negligence (if allowed by the laws of this State) by Stable or its representatives, agents or employees.

Trainer shall assume that Owner desires surgical care if recommended by a veterinarian in the event of colic, or other life-threatening illness, unless Trainer is instructed herein by Owner or on Owner's Information Sheets, that the horse(s) is/are not surgical candidates.

Owner agrees to notify Trainer of any and all change of addresses, emergency telephone numbers, itineraries or other information reasonably necessary to contact Owner in the event of an emergency. In the event Owner departs for vacation or is otherwise unavailable, prior to departure Owner shall notify Trainer as to what party is authorized to make decisions in the Owner's place with regard to the health, well-being, and/or medical treatment of the horse(s).

However, Trainer will not be obligated to retain and/or maintain the horse(s) in question in the event the amount of the bill exceeds the

anticipated unregistered value of the horse(s.) In the event Trainer exercises Trainer's lien rights as above-described for non-payment, this Agreement shall constitute a Bill of Sale and authorization to process transfer applications from any breed registration as may be applicable to said horse(s) upon affidavit by Trainer's representatives setting forth the material facts of the default and foreclosure as well as Trainer's compliance with foreclosure procedures as required by law. In the event collection of this account is turned over to an attorney, Owner agrees to pay all attorney's fees, costs, and other related expenses for which a minimum charge of $250.00 will be assessed.

Dos and Don'ts

When filling out the Horse Training Contract form, there are important considerations to keep in mind. Here are five things you should and shouldn't do:

  • Do read the entire contract carefully before signing. Understanding all terms is crucial.
  • Don't leave any sections blank. Fill in all required information to avoid delays or misunderstandings.
  • Do provide accurate details about your horse, including its health history and any special needs.
  • Don't neglect to communicate any hazardous behaviors or health issues related to your horse.
  • Do keep a copy of the signed contract for your records after submitting it.

Key takeaways

Here are key takeaways for filling out and using the Horse Training Contract form:

  • Complete Information: Fill in all required fields, including the date, trainer's name, owner's name, and horse details to ensure clarity.
  • Understand Fees: Be aware of the monthly or daily training fees and any applicable taxes. Know the minimum training duration before signing.
  • Payment Terms: Monthly fees are due on the 1st of each month. Late payments incur a fee, so keep track of due dates.
  • Health Requirements: Ensure your horse is healthy and up to date on vaccinations. The trainer can arrange care if necessary, but costs will fall to you.
  • Training Expectations: Understand that the trainer cannot guarantee specific results. Training effectiveness depends on the horse’s individual abilities.

  • Liability Awareness: Acknowledge that the trainer is not liable for injuries or losses unless due to negligence. Consider obtaining equine insurance for added protection.

  • Facility Inspection: Inspect the training facilities before signing. Confirm they meet your standards for safety and care.

Similar forms

The Boarding Agreement is a document that outlines the terms under which a horse owner can board their horse at a facility. Similar to the Horse Training Contract, it specifies fees, duration of stay, and responsibilities of both the owner and the facility. It also includes provisions for care and handling of the horse, including health and safety standards. Both documents emphasize the importance of clear communication between the owner and the service provider to ensure the well-being of the horse.

The Lease Agreement for Horses serves a similar purpose, detailing the terms under which a horse may be leased for training or riding. Like the Horse Training Contract, it includes information on payment, duration, and responsibilities of both parties. It also addresses the care and management of the horse, ensuring that both the lessor and lessee understand their obligations. The emphasis on the horse's health and safety is a common thread in both documents.

A Farrier Service Agreement is another document that shares similarities with the Horse Training Contract. This agreement outlines the services provided by a farrier, including hoof care and maintenance. Both contracts address payment terms and the responsibilities of the horse owner regarding the care of their horse. Furthermore, they both highlight the importance of regular maintenance to ensure the horse's overall well-being.

The Veterinary Services Agreement is akin to the Horse Training Contract in that it establishes the terms under which veterinary services will be provided to a horse. This document details the responsibilities of the horse owner, including payment for services and the necessity of regular health checks. Both agreements underscore the importance of maintaining the horse's health and provide guidelines for addressing any medical needs that may arise.

The Horse Sale Agreement is a document that outlines the terms under which a horse is sold from one party to another. Similar to the Horse Training Contract, it includes details about payment, transfer of ownership, and any warranties regarding the horse's condition. Both documents require clear communication and mutual understanding to prevent disputes and ensure a smooth transaction.

The Equine Liability Release is a document that releases a trainer or facility from liability in the event of injury or damage related to horse activities. Like the Horse Training Contract, it emphasizes the inherent risks involved in working with horses and requires the owner to acknowledge these risks. Both documents aim to protect the service provider while ensuring that the owner understands their responsibilities and the potential dangers involved.

The Horse Show Entry Form is similar to the Horse Training Contract in that it outlines the terms of participation in a specific event. This document includes information on fees, responsibilities, and the required health documentation for the horse. Both forms emphasize the importance of compliance with rules and regulations to ensure the safety and success of the horse and rider.

The Horse Insurance Policy is a document that provides coverage for a horse in the event of injury, illness, or death. Similar to the Horse Training Contract, it requires the owner to understand their responsibilities in maintaining insurance coverage. Both documents highlight the importance of protecting the owner’s investment and ensuring the horse's well-being during training and other activities.

The Riding Lesson Agreement is a contract that outlines the terms under which riding lessons will be provided to an individual. Like the Horse Training Contract, it includes details about payment, lesson duration, and responsibilities of both the instructor and the student. Both documents emphasize the importance of safety and proper care during lessons, ensuring that the horse is treated with respect and care.

The Equine Boarding and Training Agreement combines elements of both boarding and training contracts. It outlines the terms of both services, including fees, duration, and responsibilities. Like the Horse Training Contract, it emphasizes the importance of communication and understanding between the owner and the service provider to ensure the best care for the horse during its stay.

Documents used along the form

The Horse Training Contract is an essential document for outlining the responsibilities and expectations between a horse owner and a trainer.
